You are receiving this message because you or your organization are a subscriber of Algolia’s hosted search and related services, and we have a few important pieces of information to give to you.
The European Union’s General Data Protection Regulation (GDPR) will become effective on May 25, 2018, imposing stricter personal data protection and privacy requirements. We know that preparing for this regulatory change is a priority for many of our customers and it is a priority for us as well.
In preparation for GDPR, (i) we are rolling out a new Data Processing Addendum (DPA) which will become part of our subscription documents, (ii) updating our online Terms of Service (previously referred to as the General Terms and Conditions of Use of Algolia’s Services), and (iii) updating our Privacy Policy, as described below.
Please click here to download, review, countersign, and return our new DPA to privacy@algolia.com if your organization is established in the European Union (EU) or subject to GDPR. Once executed and delivered to Algolia, the DPA will become part of your Algolia subscription documents and will replace existing applicable data processing and security terms as of May 25, 2018. If you are, or represent, one of our customers that has signed a separate GDPR-compliant data processing agreement or addendum with us, the terms of your existing data processing addendum or agreement will continue to apply and you do not need to take any other steps.
GDPR requires Algolia to maintain records of certain information, including the contact details of your Data Protection Officer (DPO), where applicable, and EU representative if your organization is subject to GDPR but not established in the EU. Please click here to sign into your Algolia user interface dashboard and provide the applicable contact information under the "Contacts" tab. As you will see, we have also created a place for you to provide the contact information for security matters.
In addition to GDPR-related changes, some of the notable changes we made to our Terms of Service include clarifying: (i) our security commitments; (ii) our customers responsibilities and commitments to us when using our services including regarding our documentation and acceptable use policy; (iii) our promises regarding our services; (iv) our requirements for interacting with non-Algolia services as instructed by our customers; (v) the mechanism for notifying our customers for misuse of our services and third party notices; (vi) updating our limitation of liability and indemnification provisions; (vii) our warranties for our services; and (viii) our notice provisions.
Our new Terms of Service will supersede the existing General Terms and Conditions of Use of Algolia’s Services as of May 25, 2018. You may access and review our new Terms of Service here.
If you are, or represent, one of our customers that has signed a separate subscription agreement including a GDPR-compliant data processing agreement or addendum with us, the terms of your existing agreement will continue to apply and you do not need to take any other steps.
We have revamped our Privacy Policy to provide more details on how we process personal data from (i) visitors to our websites, (ii) interactions with our customers, (iii) data submitted to our services by our subscribers or their end users, (iv) individuals registered to attend our marketing or corporate events, and (v) our customers’ personnel through our websites, interactions or communication with them.
